TERMS AND CONDITIONS

ARTICLE 1: OBJECT

These GCS define the rights and obligations of the parties in the context of the distance selling of products offered by Jardiniste to customers via the site www.jardiniste.fr

Any use of the Site or placing an order implies acceptance of the GCS by the Customer.

Jardiniste reserves the right to modify the T&Cs at any time and without notice, it being specified that only the T&Cs in force on the date of use of the site and/or placing an order by the Customer will be applicable.

ARTICLE 2. INFORMATION ON PRODUCTS & THEIR AVAILABILITY

The products sold by Jardiniste comply with the French regulations in force.

They are described as precisely as possible using product sheets and photos.

However, the photos used by Jardiniste to present the products have no contractual value, particularly with regard to color and size. The customer is invited to refer to the detailed descriptions of the product, and if necessary, the Customer is invited to contact the customer service of Jardiniste to obtain any useful clarification. The products are marketed within the limits of available stocks. In case of exhaustion of stocks, Jardiniste will endeavor to indicate it clearly and/or to make it impossible to purchase the product concerned. However, it may exceptionally happen that a product ordered is no longer available. In such a case, Jardiniste undertakes to immediately inform the customer and to reimburse the full amount paid using the same means of payment as that previously used by the Customer.

ARTICLE 3. ORDERS

Jardiniste reserves the right to refuse any order provided that it justifies legitimate reasons, in particular when the quantities purchased are abnormally high for a consumer or in the event of a dispute concerning the payment of a previous order.

ARTICLE 4. PRICE AND PAYMENT

The price of the products is mentioned in euros (€), all taxes included (TTC), excluding delivery costs which are the responsibility of the Customer, (except one-time promotional operation), and are notified to the latter when placing an order. .

Jardiniste reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of the validation of the order. However, if an abnormally low price is indicated due to a technical or human error, Jardiniste reserves the right to ask the Customer to supplement the price already paid or to allow him to cancel his order by reimbursing him all sums already paid.

Jardiniste is likely to organize various promotional operations, via, in particular, proportional codes. These do not apply to delivery costs, with the exception of free delivery codes which only apply to the amount of delivery costs.

Payment for orders is only made online by credit card (Visa, Mastercard and American Express) via the secure Stripe platform. Checks and cash are not accepted for online payments.

Jardiniste reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

The products ordered remain the property of Jardiniste until full payment.

ARTICLE 6 – DELIVERY

The delivery method offered for France is Colissimo.

Any shipment of an order will be notified by Jardiniste to the Customer by sending an email allowing the shipment to be tracked. Delivery will be deemed to have been made when the Customer or a third party designated by him, and other than the carrier proposed by Jardiniste, takes physical possession of the product.

Jardiniste strives to ship your order within 48 hours, working days, of receipt. However, delivery times are given for information only and cannot be binding on Jardiniste. The delivery of several products from the same order may be fragmented (the Customer will be informed by email).

Any apparent anomaly concerning an order (number of units, condition of the packaging, etc.) must be indicated precisely (detailed description of the anomaly) by the Customer on the carrier's delivery slip, in the presence of the latter. The Customer must immediately inform Jardiniste by providing any useful evidence (photograph, description of the anomaly, etc.). An apparent anomaly means any anomaly that would normally be detected by a normally attentive and informed consumer. Otherwise, the products will be deemed to have been delivered free of any apparent anomaly. It is therefore up to the Customer to preserve his rights vis-à-vis the carrier under the conditions provided for in Article L.133-3 of the Commercial Code (motivated confirmation of the anomaly with the carrier by sending a registered letter within 3 days, not including public holidays, following receipt of the products concerned)

ARTICLE 7 – GUARANTEES

We take great care when preparing packages. However, the order may have a defect that we had not noticed. The customer must therefore take care to check the conformity of his order upon receipt. If a non-conformity is detected concerning the product (defective, damaged, missing or damaged product) the customer is invited to notify Jardiniste's customer service within a maximum of 72 hours after receipt by email to hello@jardiniste.fr.

Jardiniste reserves the right to decide on the most suitable provision for the defect encountered, namely, a replacement or a refund. If no claim has been made after the 72-hour period, Jardiniste disclaims all liability.

ARTICLE 8 – WITHDRAWAL

Customers are informed that they have the right to withdraw without giving any reason within a period which expires 14 days after receipt of the goods.

If this period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.

The right of withdrawal cannot be exercised for contracts listed in Articles L. 221-2 and L. 221-28 of the Consumer Code, in particular: - Supply of goods made to the consumer's specifications or clearly personalized; - supply of goods liable to deteriorate or expire rapidly; - supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

To exercise their right of withdrawal, Customers are invited, before the expiry of the aforementioned period, to notify their decision to withdraw to the Gardener's Customer Service by means of an unambiguous declaration (e.g. letter sent by post, E-mail…).

After having exercised their right of withdrawal, Customers are invited to return the property concerned to the following address: Jardiniste, 87 rue du Ranelagh, 75016 Paris, France no later than 14 days after having informed Jardiniste of their decision to withdraw. This deadline is deemed to have been respected if the goods are returned before the expiry of this deadline. The costs and risks associated with the return are the sole responsibility of the Customers.

In the event of withdrawal, Jardiniste will refund the payment received for the goods no later than 14 days from the day on which Jardiniste receives the package being returned. The same means of payment as the one used when ordering will be used.

ARTICLE 9 - RETURN

The products must be returned at the Customer's expense in their original packaging and in perfect condition for resale (not damaged, damaged or soiled).
They must imperatively be accompanied by all their accessories.

The return is made by parcel post, at the Customer's risk and peril, to:

ARTICLE 10 – INTELLECTUAL PROPERTY

All the creations, photographs, texts, and various graphics present on the jardiniste.fr site are strictly reserved under copyright as well as intellectual property and for the whole world.

As such and in accordance with the provisions of the intellectual property code, any reproduction or total or partial representation of Jardiniste's creations or of all or part of the elements found on the jardiniste.fr site is strictly prohibited and will be subject to lawsuits.

ARTICLE 11 – PERSONAL DATA

Jardiniste undertakes to process the personal data collected in accordance with the regulations in force. In this context, Jardiniste undertakes, except for exceptions provided for by law, to obtain the consent of its Customers each time it collects personal data concerning them. This data is collected and processed for the purposes of customer management and optimization of the customer experience. They allow, among other things, the management of loyalty and promotion, statistics, etc. They are kept for the time strictly necessary for the fulfillment of these purposes and are never communicated to third parties, unless this is necessary for the execution. of the T&Cs. The fact that a Customer does not communicate to Jardiniste the data concerning him indicated as being mandatory may have the consequence of making any use of the Site impossible. The Customer has a right of withdrawal of his consent, portability, access, rectification, update and deletion of his data which he can exercise by contacting the customer service of Jardiniste.

ARTICLE 13 – APPLICABLE LAW

The T&Cs are fully governed by French law.

The language of this contract is French.

In the event of a dispute, the French courts will have sole jurisdiction.
